Privacy Policy

This policy explains how [OPERATOR LEGAL NAME] (ABN [ABN]), trading as Markly ("Markly", "we", "us"), collects, uses, stores and protects personal information when you use the Markly app and website at markly.com.au. We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), whether or not the Act strictly requires us to — because much of the information in Markly is about school students, and it deserves that standard.

Tutors decide what student information to enter. We process it only to provide the service to the tutor and to the student's family through the parent and student portals.

2. Children's information

Most students in Markly are under 18. We rely on the tutor — who has the direct relationship with the family — to obtain consent from a parent or guardian (or from the student, if an adult) before entering a student's information. Our Terms of Service make this a binding obligation on every tutor.

We do not sell personal information, and we do not share it with advertisers.

4. AI processing

Some Markly features use an AI model (Anthropic's Claude) to draft documents — for example lesson plans, parent updates, and suggested scores from a photo of homework. When a tutor uses these features, the relevant content (such as topic names, scores, session notes, or the homework photo) is sent to Anthropic's API to generate the draft.

Local mode

Out of the box, Markly runs entirely in your browser. All data is stored in your device's local browser storage and never reaches our servers. If you clear your browser data, it is deleted. Back it up using the in-app export.

Cloud mode

When cloud sync is enabled, data is stored with our database provider, Supabase, in the [REGION — e.g. Sydney, Australia (AWS ap-southeast-2)] region. Access is protected by row-level security: tutors can only see their own students, and parents and students can only see what their tutor has published to them.

You can ask us for a copy of the personal information we hold about you (or your child), or ask us to correct it, by emailing [CONTACT EMAIL]. We'll respond within 30 days. There is no charge for making a request.

10. Cookies and local storage

Markly uses your browser's local storage to make the app work — to keep you signed in and, in local mode, to store your data. We do not use third-party advertising cookies. If we add analytics in future, we will update this policy first.

11. Marketing emails

We only send marketing emails to people who have opted in (for example, by requesting a sample test). Every marketing email contains a working unsubscribe link, and unsubscribing takes effect within 5 business days. Service emails (like receipts and important account notices) are sent to account holders regardless, as permitted by law.

If you're not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or 1300 363 992.

If we change this policy in a material way, we'll notify account holders by email or in-app notice before the change takes effect. The "Last updated" date at the top always reflects the current version.
